Section 01
Definitions
"We" / "Us"Resonance Multimedia, based in Alexandria, Virginia.
"You" / "Client"The business or individual who has subscribed to our website service.
"The Service"The website design, hosting, domain management, and ongoing maintenance provided under your chosen plan (Basic, Standard, or Pro).
"The Site"The website we build and maintain on your behalf as part of the Service.
"The Domain"The web address (e.g. yourbusiness.com) associated with your Site.
"Subscription"Your active, paid monthly or annual plan giving you access to the Service.
Section 02
The Service
We build, host, and maintain a professional website for your business. What's included depends on your plan:
Basic — $29/moOne-page scrolling site with modal contact form, custom domain, hosting, and optional custom domain email via Google Workspace (additional fees apply).
Standard — $49/moThree-page site (Home, Gallery, Contact), Google Map embed, 2 included updates per month, and custom domain email via Google Workspace included at no additional charge.
Pro — $69/moThree-page site with blog/news section, unlimited minor updates, monthly traffic report, custom forms, and custom domain email via Google Workspace included at no additional charge.
Always included on every plan
Correcting factual errors (wrong phone number, outdated hours), replacing a broken image you provide, and updating a service name or price — always handled at no extra charge.
The following are outside scope and available on request at a negotiated fee agreed upon before any work begins:
- Adding new pages or major sections not in the original build
- Redesigning the site layout or switching to a new template
- Integrations with third-party booking, ordering, or e-commerce systems
- Custom functionality beyond standard static HTML and CSS
We'll always provide a clear estimate and get your approval before starting any out-of-scope work. No surprises.
Section 03
Your Domain
Your domain — the web address people use to find your business — is managed by us for the duration of your subscription. How that works depends on your situation:
New domainIf you don't already have a domain, we register one in our AWS account. It's yours to use as your business address for as long as you remain a client. We will never sell it, transfer it to a third party, or let it expire without notifying you first.
Existing domain (you keep it)If you already own a domain and want to keep it where it is, we'll point it to your new site. Your domain stays in your account, under your control, at all times. The $200 transfer fee does not apply.
Existing domain (transfer to us)If you prefer, you can transfer your existing domain to our account and we'll manage it alongside your site. The same terms as a new domain apply, including the purchase option on cancellation.
Plain language version
If we registered your domain, think of it like a phone number we hold in trust for you — it's yours to use while you're a client, and you can buy it outright for $200 if you ever leave. If you already own your domain, nothing changes — it stays yours no matter what.
For domains we registered on your behalf: if you cancel and would like to keep the domain, you may purchase it for a one-time domain transfer fee of $200. Upon receipt of payment, we will transfer the domain to an account of your choosing within 7 business days.
If you do not exercise this option within 90 days of cancellation, the domain remains in our account and may be retired or reused at our discretion.
Section 04
Payment
Payment is by credit or debit card, charged automatically on a recurring basis. A valid card on file is required to maintain an active subscription.
Monthly billingCharged on the same date each month. You'll receive an automatic receipt by email after every successful payment.
Annual billingPay upfront for 12 months and get 2 months free (~17% savings). Charged once per year.
Failed paymentsIf a payment fails, we'll retry automatically over the following 7 days. You'll receive an email notification so you can update your card if needed.
Grace periodIf payment has not been collected within 30 days of the original due date, your site will be suspended until the balance is cleared.
SuspensionSuspended sites are restored within 24 hours of successful payment. Sites suspended for more than 60 consecutive days may be permanently taken offline.
Out-of-scope workAny billable work outside your plan scope is invoiced separately and due within 14 days.
Section 05
Cancellation
There is no long-term contract. You can cancel at any time with 30 days written notice sent to the email address on file.
When a subscription ends:
- The site is taken offline at the end of the final paid period
- No website files, code, or assets are transferred to you
- The domain remains in our account (see Section 3 for the $200 purchase option)
- No refunds are issued for partial months or unused portions of annual prepay periods
A note on cancellation
We'd always rather fix a problem than lose a client. If something isn't working — the site, the communication, anything — please reach out before cancelling. We'll make it right.
Section 06
Content & Ownership
Your content is yours. Everything you provide — your business name, photos, descriptions, logos, and other materials — remains your property at all times. You grant us a limited license to use this content solely for the purpose of building and maintaining your website during the subscription period.
Our work is ours. The underlying template, code, design system, and technical infrastructure we use to build your site remain our property. During your active subscription, you have a license to use them as your website. That license ends when the subscription ends.
You represent that you have the right to use all content you provide to us, and that it does not infringe on any third party's rights.
Section 07
Liability
We will make every reasonable effort to keep your site live, accurate, and performing well. That said, we are not liable for any loss of business, revenue, customers, or reputation arising from:
- Temporary site downtime or technical errors
- Changes in search engine rankings or visibility
- Third-party service interruptions (hosting, DNS, form providers)
- Circumstances beyond our reasonable control
Our total liability under this agreement is limited to the amount you paid us in the 30 days preceding the claim.
Section 08
Indemnification
You agree to indemnify, defend, and hold harmless Resonance Multimedia, its owner, and any contractors we engage from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Content you provide us that infringes a third party's intellectual property, privacy, or other rights, or that violates any law
- Your business operations, products, or services as promoted through the Site
- Your breach of these terms or misuse of the Service
This obligation survives cancellation of your Subscription.
Section 09
Changes to Terms
We may update these terms from time to time. If we make a material change, we'll notify you by email at least 30 days before the change takes effect.
Continued use of the service after the effective date constitutes acceptance of the revised terms. If you don't agree with a change, you're always free to cancel before it takes effect.
